The Asst. Registrar of Trade Marks held that the word ‘MAALI’ is a common dictionary word meaning a gardener and in the absence of secondary significance, it can not be monopolised. The order further observed that multiple third-party registrations incorporating the expression ‘MAALI’ dilute any claim to exclusivity and that the composite mark ‘URBANMAALI’ creates a distinct overall commercial impression. The Opponent also failed to establish prior use or reputation for goods falling in class 20, namely flower stands, plant stands and metal furniture. Accordingly, the opposition was dismissed and the application was directed to proceed to registration.
