The Learned Commercial Court, Saket, Delhi, relying upon Ok Play India Pvt. Ltd. vs A.P. Distributors & Anr, held that not only must the Written Statement in a commercial suit be filed within the outer limit of 120 days under Order VIII Rule 1 CPC, but the application seeking condonation of delay must also be filed within the said period. An application for condonation filed beyond 120 days is not maintainable and the Written Statement is liable to be taken off the record.
