The Asst. Registrar of Trade Marks in a very detailed order held that the reputation attached to the well-known mark ‘BRITANNIA‘ cannot automatically be extended to a standalone red pentagonal device. The order further holds that the said device, by itself, does not possess independent distinctiveness separate from the composite BRITANNIA mark. Accordingly, the opposition was dismissed and the application was directed to proceed to registration.
